These Terms of Service (“Terms”) govern your access to and use of FACTYN (the “Service”), a manufacturing OEE and downtime-analytics product provided by Kapturi LLC (“Kapturi”, “we”, “us”). By creating an account or using the Service you agree to these Terms on behalf of your organization (the “Customer”).
FACTYN lets your team record production runs, downtime and waste, and view OEE and loss analysis. We may update, improve, or change features over time. We aim for high availability but do not guarantee uninterrupted access.
You are responsible for the accounts you create, for keeping credentials secure, and for the activity of your users. You must provide accurate information and use the Service only for lawful purposes and in line with these Terms.
New accounts start on a 14-day free trial with full feature access. When the trial ends, premium features are locked until you move to a paid plan; your data remains available. Paid plans, where offered, are billed per the order you agree to with us. We will tell you the price before you are charged.
You own the data you put into FACTYN (your plant configuration and production records). We process it to provide the Service, as described in our Privacy Policy and Data Processing Addendum. You can export your data at any time from Settings.
Don't misuse the Service: no attempts to breach security or access other tenants' data, no reverse engineering except as permitted by law, no uploading of unlawful content, and no use that overloads or disrupts the Service.
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. OEE figures and analytics are computed from the data you enter and are intended as operational insight, not as a guarantee of outcomes.
FACTYN is an analytics and reporting tool. It is not a process-control system, a safety system, or a substitute for either, and it must not be used to operate, control, or protect machinery or people. Its figures depend on the data your team enters. Operational decisions — including stopping, starting, staffing, or maintaining equipment — are made by you and remain your responsibility.
To the maximum extent permitted by law, Kapturi will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these Terms. On termination you can export your data; after a reasonable period we may delete it as described in the Privacy Policy.
We may update these Terms; we'll change the “last updated” date and, for material changes, give reasonable notice. Questions: support@kapturi.com.
